Who Owns Ashes

When a loved one is cremated, questions often arise about the ownership of the cremated remains, also known as ashes.

In the UK, the legal situation is somewhat unique. Unlike property, ashes are not “owned” in the traditional sense. The person who has the right to decide on the cremation—usually the executor of the will or the closest next of kin—also has the responsibility to decide what happens to the cremated remains.

Whether you choose to keep them, scatter them in a meaningful place, or have them interred, it’s important to have these discussions early on. At Pearson Funeral Service, we offer guidance and support through these delicate matters. We’re here to help you navigate these decisions with care and respect.
